Swimming Lessons Cash Customers - Terms and Conditions

All swimming lessons are arranged by The Borough Council of Calderdale ("The Council") of The Town Hall, Crossley Street, Halifax, West Yorkshire, HX1 1UJ. This Agreement specifies the terms and conditions of the Council's swimming lessons at any of its managed swimming pool Centre ("Centre"). The Customer is advised to read the whole of this agreement carefully. The Agreement is made between the Council and you ("The Customer").

  1. Definitions

    1. Course of Lessons means a number of swimming lessons, which last up to 14 calendar weeks.
    2. Working Day means Monday to Sunday excluding public holidays.
    3. Participant means a child who is taking part in the swimming lessons.
    4. Customer means Parent / Guardian of the Participant
    5. Suitable Evidence means formal evidence of illness from a doctor or nurse.
  2. General

    1. Participation in a Course of lessons does not include a swim before or after the lesson.
    2. Unless the context otherwise requires, words in the singular shall include the plural and vice versa.
  3. Swimming Lessons

    1. The course of swimming lessons lasting a total of 50 weeks throughout the calendar year.
    2. Swimming lessons last between 30 minutes and 45 minutes depending on the level of the lesson.
    3. Swimming lessons will not run for two weeks during the Christmas period.
    4. At the start of a new Course of Lessons, the Council will identify any Course of Lessons that are not economically viable to run. In this case, the Council will give the opportunity to the Customer to move to another Course or give a full refund back to the Customer.
    5. The Council may consider refunding monies paid by Customers for a Course of Lessons if they have missed over fifty percent of lessons due to an illness or any other exceptional reasons. Customers must provide Suitable Evidence to reflect the absence. The Council will credit the Customer for the number of missed lessons on the following Course of Lessons. If the Customer does not want to continue for another Course of lessons, the Council shall then refund the Customer any monies paid.
  4. Payment / Cancellation

    1. Subject to clause 4.2, no refunds will be given once a Customer has agreed to start the Course Of Lessons.
    2. In exceptional circumstances such as, but not limited to, pool facilities not working, extreme weather conditions and teacher sickness, the Council may cancel swimming lessons with or without giving reasonable notice. The Council will credit the Customer for another lesson.
    3. Customers who have an outstanding balance on their account will not be able to enrol on to a new Course of Lessons until the outstanding balance has been paid in full.
    4. Subject to clause 4.2, customers who wish to cancel the Course of lessons once the swimming lessons have started will be liable for the full amount of the Course.
    5. Pricing of the Course of lessons may be subject to change at any time throughout this agreement. The Council will use its best endeavours to give reasonable notice to the Customer of any price change.
  5. Termination

    1. The Council reserves the right to terminate a Course of Lessons if, but not limited to:
      • The Customer breaches this agreement and/or breaches the rules of the Centre or any other Council facility
      • Any part of your account balance remains unpaid after its due date; and/or
      • The Customer provides the Council with details which he/she knows to be false
      • Management discretion If the Council terminates for any of the reasons above, the Council reserves the right to retain a proportion of the money paid to cover any reasonable costs incurred.
    2. If the agreement is terminated by the Council for abusive or threatening behaviour, this agreement will cease with immediate effect. No refunds will be given and any outstanding monies will be immediately payable by the Customer.
  6. Health and Safety

    1. It is the Customer’s own responsibility to inform the Council If any Participants suffer from health problems that may affect the swimming lesson. It is the Customers responsibility to ensure any appropriate medication is available at all times for the Participants.
    2. Customers must inform the Council if the Participant suffers from Epilepsy or any serious illness that may affect the performance of the swimming lesson and impact on their health. The Council shall than undertake an individual risk assessment with the Centre manager.
    3. Participants under the age of 5 shall be supervised by a parent or guardian in and out of the water at all times on a one to one basis unless authorised by the Centre manager.
    4. Participants under the age of 8 must be supervised by a parent or guardian through the swimming lessons and must be available for the Participant at all times. The Customer acknowledges that they have been explained and handed over these Terms & Conditions, which the Customer accept as binding.
