PSPO for Anti-Social use of Vehicles

We aim to reduce the impact of this type of behaviour in Calderdale.

With support from the Community Safety Partnership, we have introduced a Public Space Protection Order (PSPO), to:

  • Limit the anti-social use of vehicles within the borough.
  • Address a range of anti-social behaviour (ASB) and activity where we often see vehicles involved.

The Order

What we aim to tackle

  • Too much noise from vehicles.
  • Danger caused to other road users or members of the public using the highway or open spaces, such as parks.
  • Damage to private property.
  • Where people gather or 'hang around' in a way that causes or is likely to cause:
    • alarm, harassment or distress;
    • or simply a harmful impact on quality of life.

What is exempt

  • Emergency services;
  • statutory duties;
  • and certain authorised activities.

Note: Mobility scooters and similar disability aids are not covered by this order.

Penalty for a breach of the Order

Both the Council and Police can issue a fine of £100.

If a person refuses to pay, they will be prosecuted in court and if found guilty:

  • the court can impose a higher fine;
  • or other penalties, which will also include a criminal record.

  • time;
  • date;
  • location;
  • a description of the vehicle or people involved;
  • and any photos, videos or dashcam footage.

How we will measure the success of the PSPO

We will monitor levels of anti-social behaviour, public reports and enforcement activity.
