Privacy Notice – How we use your information
Calderdale Metropolitan Borough Council of Town Hall, Crossley Street, Halifax, HX1 1UJ is registered with the Information Commissioners Office (ICO) under the provision of the Data Protection Act 2018. The Council takes its responsibilities as Data Controller under the Data Protection Act and UK GDPR very seriously.
This privacy notice explains how your personal information will be processed by Calderdale Council's Community Protection team, who investigate and respond to reports of anti- social behaviour and criminality within our communities.
This privacy notice covers the following services:
- Environmental Health including abandoned vehicles, dog control orders, drainage and sewers, FPN notices, nuisance (e.g. noise, air pollution, fly- tipping), pest control, food hygiene, animal welfare, caravan sites, environmental permits, public space protection orders and land, air and water quality
- Community Enforcement Officers
- Community Safety Wardens
- Community Safety & Resilience Team
- Emergency Planning
The type of information we will collect:
The following personal information may be collected either directly from you, from third parties (e.g., members of the public, local councillors acting upon your behalf, surveillance cameras and other agencies such as the police), dependent upon the nature of your involvement with the Community Protection team:
- Personal information (such as name, address, contact details, date of birth, language)
- Sensitive information (such as ethnicity, physical and mental health)
- Criminal record information (such as previous convictions)
- Financial information including debit/credit card details
- Fixed Penalty Notice details
- Personal circumstances (such as lifestyle and behaviour, family details, involvement with other services)
- Housing information including Landlord's details
- Images from surveillance/mobile cameras (Personal identifiers, contacts, vehicle registration numbers)
- Any other information legally required in the discharge of the specific statutory obligation
Why we collect and hold this information
- enable us to carry out specific functions for which we are responsible
- investigate complaints such as fly-tipping, pollution and contamination including noise, nuisance, anti-social behaviour and community issues and take any necessary enforcement action
- to process the issuing and payment of fixed penalty notices (FPNs)
- collect mental health and safeguarding information which may lead to a referral
- Food hygiene including responsibility for carrying out inspections and enforcement
- Land, air and water contamination checks and enforcement
- To facilitate emergency planning, maintain contact lists and support people in emergency situations, including managing rest centres in an emergency situation to provide shelter and appropriate welfare
- to help us assess the effectiveness of the service and to plan and improve future services
Sharing your personal data
Your information may be obtained from and shared with, the following types of organisations/services as appropriate:
- Other Calderdale Council services as necessary.
- Emergency Services – Police, Fire and Rescue.
- The Criminal Justice System.
- The Food Standards Agency.
- Trading Standards.
- The Health and Safety Executive.
- The Water Authority.
- Environment Agency.
- Department for Environment, Food and Rural Affairs.
- Public Health England.
- Housing providers.
- DVLA.
For Emergency Planning purposes, information may be shared with the following category 1 and 2 responders: West Yorkshire Police, West Yorkshire Fire and Rescue service, Yorkshire Ambulance service, Yorkshire Water, Canal and River Trust, Environment Agency, Met Office, Calderdale Clinical Commissioning Group, NHS England, Northern Power Grid, Northern Gas Networks, Calder Valley Search and Rescue and with voluntary groups if consented to.
We will only ever share relevant information about you with third parties where there is a legal basis for us to do so.
The lawful basis for the processing your data
We collect and use this information in respect of Community Safety services. this is for the purposes of carrying out our statutory duties under, but not limited to:
- Crime and Disorder Act 1998.
- Anti-Social Behaviour Act 2003.
- Anti-Social Behaviour, Crime and Policing Act 2014.
Our Environmental Health service processes your personal data under the Local Government Acts, the Localism Act 2011 and specific legislation including that in respect of animal boarding and welfare, breading and control of dogs, caravan sites, clean air, pollution, food safety, housing and others.
The processing of your personal data in respect of Emergency Planning is necessary for our compliance with the statutory requirements of the Civil Contingencies Act 2004.
We process personal information and special category data under the following GDPR lawful bases:
- Article 6(1)(e) – for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
- Article 9(2)(g) - processing is necessary for reasons of substantial public interest.
- Article 9(2)(i) – processing is necessary for reasons of public interest in the area of public health.
- DPA 2018 Schedule 1 Part 2 (6) - statutory and government purposes.
The nature of our service means that we need to collect data about criminal offences. In order to collect this, we must comply with UK General Data Protection Regulation Article 10. The Council meets this requirement.
Retaining your personal information
We will kept your information for a specific length of time, then it will be securely destroyed.
Retention dates are currently under review and will be published later in 2024.
