The Council takes its responsibilities as Data Controller under the Data Protection Act and UK GDPR very seriously.
The type of personal information we collect
When registering an Expression of Interest in the scheme the following information will be collected directly from you:
- Name
- Address
- Contact details (telephone number and/or email address)
When applying for the Cycle Hanger Scheme the following information will be collected directly from you:
- Name
- Address
- Contact details (telephone number and/or email address)
- Financial information
Why we collect and hold this information.
When making an Expressions of Interest: information provided by you for the purpose of processing your expression of interest in the Cycle Hanger Scheme is collected to maintain accurate records of your name and contact details, and so you can be contacted about the scheme. The address provided as part of your expression of interest will also be used to for the purposes of determining demand for and the distribution of cycle hangers – and will be used to contact you about applying for a Cycle Hanger if one is installed in your area. We rely on consent for processing Expression of Interest information, you may withdraw this consent at any time by writing to cycle.parking@calderdale.gov.uk
When applying for a Cycle Hanger: When making an application for a Cycle Hanger or to be involved in the Cycle Hanger Scheme, information provided by you will be used for the following purposes:
- for the administration, monitoring, and management of your application.
- to process your application and where your application is successful, for the purpose of entering you into a Cycle Hanger contract with the Council.
- To manage and maintain your contract with the Council.
- For the purposes of making payments
- To prevent the misuse of the Council’s Cycle Hanger Scheme
Sharing your information
Details of all financial transactions will be shared with our finance department. In the event that money needs to be paid back to the council, your personal information may also be shared with our finance department for the purpose of debt recovery via the Council’s sundry debtor procedure.
Your personal information is not shared with any third-parties.
The lawful basis for the processing your data information
- Personal information provided when making an expression of interest is processed under the following legal basis: consent – Article 6(1)(a)
- Personal information provided when making an application for a Cycle Hanger is processed under the following legal basis: the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering a contract – Article 6(1)(b)
How long we will keep your personal information
Your name and contact details are recorded electronically on our system to maintain up to date records. Expression of interest information will be retained for a maximum of three years or until such time as the data is reviewed by us or removed at your request.
Where you have entered into an contract with the Council, your information will be retained for 6 years from when the last action on the contract.
Your rights
The GDPR provides the following rights for individuals. Not all rights are absolute and therefore will only apply in certain circumstances:
- The right to be informed
- The right of access
- The right to rectification
- The right to erasure
- The right to restrict processing
- The right to data portability
- The right to object
- Rights in relation to automated decision making and profiling.
You also have the right to complain to the Data Protection Officer if you feel that your data has not been handled in accordance with the law. You also have the right to lodge a complaint with the Information Commissioner’s Office at www.ico.org.uk
