How we use your information
Calderdale Council is registered with the information Commissioners Office (ICO) under the provisions of the Data Protection Act 2018. The Council takes its responsibilities under the Act very seriously.
The information provided by you is collected purely for the purposes of providing you with a response to your request for a local authority search or components of it.. We need to collect this information in order to maintain accurate records of your name, contact details so that we can return your search results. Sharing your information with us constitutes explicit consent from you for us to process your data for this purpose. Processing your data in this way enables us to perform our duties under the Local Land Charges Act 1975 and the Environmental Information Regulations EIR 2004.
To enable us to answer your queries we may share your information with a number of internal services:-
- Planning
- Environmental Health
- Lead Local Flood Authority
- Building Control
- Highways Development Control
- Housing
- Legal Services
You have the right to see what information is held about you, to have inaccurate information corrected and to have information removed from our system unless we are required by law or a statutory purpose to keep it, by writing to locallandcharges@calderdale.gov.uk.
In addition you have the right to complain to the Data Protection Officer if you feel that your data has not been handled in accordance with the law. You can contact the Council’s Data Protection Officer at information.management@calderdale.gov.uk.
Your name and contact details are recorded electronically on our system or in paper format to maintain up to date records. This information will be kept for a maximum of 7 years, in line with the requirements to retain financial records for this period and the Limitations Act 1980 unless:-
- You submitted an EIR request in which case it will be retained for 3 years after receipt or
- You submitted a general enquiry concerning searches and it doesn’t relate to a specific search request or an EIR request, in which case we will retain your records for a maximum of 1 year after receipt
- or until such time as the data is reviewed by us or removed at your request.
