Calderdale Metropolitan Borough Council of Town Hall, Crossley Street, Halifax, HX1 1UJ is registered with the Information Commissioners Office (ICO) under the provision of the Data Protection Act 2018.
The Council takes its responsibilities as Data Controller under the Act very seriously.
The type of information we will collect
- Your vehicle details and photographic images of the vehicle parking in contravention of the parking regulations will be received from the council's CEOs.
- Vehicle registration number.
- Personal name and addresses.
- Business name and addresses.
- Phone numbers.
- Email addresses.
- Payment details.
- Any other relevant information provided in conjunction with appealing a Penalty Charge Notice (PCN) for example: vehicle breakdown/repair reports, police reports, evidence of deliveries/collections.
- If the vehicle is hired or leased then we may request a copy of the hire/lease agreement and the hirer's driving licence details from the registered keeper of the vehicle to enable the transfer of liability.
- If the registered keeper has sold the vehicle, then we may obtain details of the new keeper from the registered keeper at the time of contravention.
The above may be collected directly from you, Civil Enforcement Officers (CEOs), the DVLA, enforcement agencies. Also, third parties such as hire and leasing vehicle companies and businesses.
Why we collect and hold this information
- To serve a PCN;
- and enforce the parking terms and conditions in accordance with the Traffic Management Act 2004.
Sharing your personal data
We will share it with:
- The DVLA, to obtain the vehicle's Registered Keeper details to issue a PCN/Notice to Owner.
- The Council's contracted enforcement agents (CDER Group and Jacobs).
- Enforcement software provider (Imperial) and Enforcement Contractors (APCOA).
- The police or security organisations where necessary to prevent or detect crime.
- Other services in order to recover outstanding debts, which includes the Traffic Enforcement Centre (TEC) and Traffic Penalty Tribunal (TPT).
We will never share your personal information with third parties without your consent unless the law allows us to do so.
The lawful basis for the processing of your data
- Article 6(c) - For compliance with a legal obligation to which the controller is subject.
- Article 6(e) - For the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Where special category data is provided and processed, the condition for processing is:
- Article 9(1)(f) – It is necessary for the establishment, exercise or defence of legal claims or whenever Courts are acting in their judicial capacity.
How long we will keep your personal information
- For a minimum of 3 years to a maximum of 7 years from issue of the PCN. (If it is in relation to the recovery of an outstanding debt).
Your rights
Not all rights are absolute and will only apply in certain circumstances. The GDPR provides these rights for individuals:
- To be informed.
- Access.
- To rectification.
- To erasure.
- To restrict processing.
- To data portability.
- To object.
- Rights in relation to automated decision making and profiling.
