How we use your information
Calderdale Council is registered with the information Commissioners Office (ICO) under the provisions of the Data Protection Act 2018. The Council takes its responsibilities under the Act very seriously.
The information provided by you is collected purely for the purposes of providing you with advice/updates/information in response to your enquiries or your requests to have trees protected and about High Hedges or Hedgerows. We need to collect this information in order to maintain accurate records of your name and contact details in the event of future enquiries regarding the protection of a tree, a trees health, high hedges or hedgerows. Seeking advice from us constitutes explicit consent from you for us to retain your contact details to enable us to provide future advice in relation to the Town and Country Planning (Tree Preservation) (England) Regulations 2012, Part 8 of the Anti Social behaviour Act (in relation to High Hedges) and the Hedgerow Regulations 1997.
Your information may be shared with Legal and Planning Services.
You have the right to see what information is held about you, to have inaccurate information corrected and to have information removed from our system unless we are required by law or a statutory purpose to keep it, by writing to planning.applications@calderdale.gov.uk
You have the right to complain to the Data Protection Officer if you feel that your data has not been handled in accordance with the law. You can contact the Council’s Data Protection Officer at information.management@calderdale.gov.uk.
Your name and contact details are held in paper or electronic format to maintain up to date records. This information will be kept indefinitely in relation to Tree Preservation Orders, High Hedges and Hedgerows, to provide historical evidence of the advice we have provided, in relation to the Town and Country Planning (Tree Preservation) (England) Regulations 2012, Part 8 of the Anti Social behaviour Act (in relation to High Hedges) and the Hedgerow Regulations 1997,unless:-
- The information relates to a general enquiry, not specific to a particular tree(s)/high hedge or hedgerow or a requested tree inspection, in which case we will retain it for a maximum of 1 year after receipt or
- The information relates to a hedgerow that has been removed, in which case we will retain the information for a maximum of 1 year after the confirmed date of the hedgerows removal
- or until such time as the data is reviewed by us or removed at your request.
