Early Intervention – Young Carers
Calderdale Metropolitan Borough Council of Town Hall, Crossley Street, Halifax, HX1 1UJ is registered with the Information Commissioners Office (ICO) under the provision of the Data Protection Act 2018. The Council takes its responsibilities as Data Controller under the Data Protection Act and UK GDPR very seriously.
This privacy notice explains how your personal information will be processed if you receive support from the Young Carers Service.
The type of information we will collect
The following information will be collected either directly from you or from the referrer (if referred via Early Intervention Panel)
- Personal details such as name, address, contact details, date of birth, and gender
- Special category data such as ethnicity, disability, and special educational needs
- Details of the illness/condition/disability within the family and the caring role the young person undertaking
- Records of our meetings and conversations with you, including your/your child’s thoughts and feelings about the caring role and the impact on you/them, and any safeguarding risks
- Any agreed outcomes or actions as a result of the young carers assessment
- Parent’s name, address, and contact details
Why we collect and hold this information
The personal data you have provided will be used to:
- Meet our statutory obligations to offer a young carer an assessment
- Contact you to offer support
- Enable work to be undertaken to support you and to support the young person to understand the harm they have caused
- Obtain feedback to help us to understand the effectiveness of the service and to develop and improve future services
Sharing your personal data
The information detailed above is kept by Calderdale Young Carers Service on an information management system. Information may be shared with other services in order to provide specific support to you. This may include Adult and Children’s Services, Health, Education or Mental Health Services (such as CAMHS and Mental Health in Schools Teams).
The lawful basis for the processing your data
We need to collect this information in order to meet our obligations (including, but not limited to):
- The Children and Families Act 2014
- The Care Act 2014
- Young Carers (Needs Assessments) Regulations 2015
We process personal information and special category data under the following GDPR lawful bases:
- Article 6(1)(c) – for compliance with a legal obligation to which the controller is subject as above
- Article 6(1)(e) – for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
- Article 9(2)(g) – processing is necessary for reasons of substantial public interest (with a basis in law)
- DPA 2018 Schedule 1 Part 2 – 8(1) Equality of opportunity or treatment; 18(1) Safeguarding of children and of individuals at risk
Retaining your personal information
Ongoing work with you/your child is based on your permission/agreement to receive support from the Young Carers Service.
You/your child’s personal information will be securely destroyed at 3 years following the closure of service. If no service is accessed, your child does not meet the criteria and/or the service is declined then your information will be securely destroyed at 1 year following closure.
Any information that is subsequently retained for evaluation purposes will be anonymous.
Your rights
The GDPR provides the following rights for individuals. Not all rights are absolute and therefore will only apply in certain circumstances:
- The right to be informed
- The right of access
- The right to rectification
- The right to erasure
- The right to restrict processing
- The right to data portability
- The right to object
- Rights in relation to automated decision making and profiling.
You also have the right to complain to the Data Protection Officer if you feel that your data has not been handled in accordance with the law. You can contact the Council’s Data Protection Officer at information.management@calderdale.gov.uk.
