We are making this Experimental Traffic Regulation Order (ETRO) to improve traffic flow and safety on Hollins Mill Lane, as there have been frequent occurrences regarding significant obstruction issues due to inappropriately parked vehicles. Hollins Mill Lane is very narrow and so any inconsiderate parking can soon restrict traffic flow and, on some occasions have prevented delivery access and this clearly disrupts businesses.
Whilst the Police have powers to enforce obstruction issues, these waiting restrictions provide another enforcement remedy, this one exercisable by the Council, which may assist in breaking the pattern of problem parking and help to make the road more accessible. It is also noted that the inappropriate parking also affected the use of the footway and so should improve safety for pedestrians too.
It should be noted that parking on the highway is not a legal right, and it is a drivers’ responsibility to find a suitable place to park where other road users and pedestrians are able to pass freely. The primary duty on the Highway Authority is to maintain traffic flow, and whilst parking on the highway is usually tolerated where possible, when concerns are raised, it is the duty of the Highway Authority to act to maintain the flow.
Scheme
The scheme (see plan below) is to introduce sections of:
- No Waiting at Any Time, and
- No Waiting during the period of Monday to Friday, 7.00am to 5.30pm
These restrictions are being promoted under an ETRO and at the end of the experimental period a decision will then be made on whether to introduce the scheme permanently. Relevant lining and signing has been introduced over the affected area to make sure the restrictions are enforceable as intended.
The Council considers an ETRO to be appropriate because the implications for the surrounding road network are uncertain and it will enable officers to assess if this is the correct restriction for the area and identify any alterations which may be required. As such, the impact of the experiment will be regularly reviewed, monitored and assessed whilst the order is in operation; the ETRO will allow the Council to react more quickly if circumstances require the measures to be modified or removed.
The ETRO commenced on 25th September 2025, and the experiment will last for a maximum of 18 months.
During the first six months of the experiment, i.e. 25th September to 25th March 2026 (or if the Order is varied, within six months from the day on which the variation or modification or the latest variation or modification came into force) there will be an opportunity for people to contribute their views and anyone who is opposed to the restrictions continuing on a permanent basis to submit an objection. Such representations will be considered carefully – they may lead to the revisions to the scheme to achieve improved results – and will help to determine if a permanent order should be made, either modified or in like terms to the relevant ETRO.
