Community right to bid

Find out about 'Assets of Community Value' and how to nominate one. Also, details of those that have been nominated in recent years.

The Community Right to Bid (CRTB) is a community right from the Localism Act.

It gives communities:

  • A right to identify a property that is believed to be of value to their social interests or social well-being.
  • A fair chance to make a bid to buy the property on the open market. (If the property owner decides to sell.)

Voluntary and community bodies can make nominations. These include community groups, local parish councils, neighbourhood forums and charities.

Successful nominations will be registered as an Asset of Community Value.

  3. It does not fall within one of the exemptions specified in Regulations. These are listed in the Assets of Community Value Regulations (GOV.UK).

The CRTB does not apply to residential property or operational land. This is defined in the Town and Country Planning Act 1990 Part 2.

Who can nominate an asset

Only voluntary and community organisations with a local connection. (Based in Calderdale or a neighbouring authority.)

This includes:

  • Neighbourhood Forums.
  • Parish Councils.
  • Unincorporated bodies of 21 named members.
  • A Charity.
  • Company Limited by Guarantee.
  • Industrial or Provident Society.
  • Community Interest Company.

Who makes a decision about whether a nomination is successful or not

We have delegated decision making powers to an officer group, led by the Corporate Asset and Facilities Management (CAFM) Team to review nominations of Assets of Community Value.

This group will use the statutory regulations and help in its assessment of information submitted by the nominating group, the owner and any other interested party before reaching its decision.

The nominating group will be informed within 8 weeks of our decision.

If you (the property owner) are not happy with our decision

You can ask to lodge a review within eight weeks of the written notification of listing.

Information will be provided directly to asset owners about how they can do this once they receive notification of our listing decision.

There is no right of appeal for the nominating group if an asset is not listed as an asset of community value. However, we must provide written reasons to that group as to why it has made the decision not to list.
