Local Plan – Inspector’s Report

The independent Planning Inspector, Miss Katie Child B.Sc. (Hons) MA MRTPI, was appointed by the Secretary of State for the Department for Levelling Up, Housing and Communities to examine the draft Local Plan.

The Council received the Inspector’s Final Report on 26th January. The next step will be consideration of the draft Local Plan by the Cabinet, which will be asked to support its adoption. The final decision will be taken by the Full Council. This will take place over the next 8 weeks.

Erratum Notice - Local Plan Main Modifications Consultation

It has been brought to the Council’s attention that the incorrect map was included in the Local Plan Main Modifications Appendix 1 (SD01.2) consultation document which is available for comment as part of the Council’s Main Modifications Consultation commencing 12th August 2022. The error relates to modification reference MM217 and site reference LP0177; Land adjacent to Ellistones Place, Saddleworth Road, Greetland. The error has now been rectified and a document containing the correct map uploaded to the Council’s consultation portal dated 20th September 2022.

A further issue has been reported in the same document in relation to modification reference MM218 and site reference LP0952; Land at New Gate Farm, Saddleworth Road, Greetland whereby the list of ‘reports required’ is missing from the Main Modifications schedule. This has been included in the re-published version of SD01.2.

Comments already submitted on the Local Plan Main Modifications Appendix 1 (SD01.2) document are unaffected by this issue but consultees are advised to take note of these changes and submit comments on the revised document as appropriate. The Council apologises for any inconvenience these errors have caused.

Document CC48.2 - Additional Changes to the Schedule of Minor Boundary Changes to Green Belt, is now available to view in the Examination Library.

The production of this Paper has been necessitated by the need to carry out a final clean-up of the Green Belt boundary following completion of the Examination Hearings into the Calderdale Local Plan.

The paper details changes that have been necessitated by base map corrections, changes to proposed site allocations and any other incidental changes that affect Green Belt as the Council moves towards consultation on Main Modifications.

This paper should be read in context with the Council’s Technical Paper on Exceptional Circumstances for the release of Green Belt (EV09), Additional Changes to Schedule of Minor Boundary Changes to Green Belt Paper (CC48.1) and Chapter 19 (Green Belt and Rural Areas) of the Calderdale Local Plan.

This paper follows on directly from the Schedule of Minor Boundary Changes to Green Belt Paper (CC48) and details additional minor boundary changes to the Green Belt.

The Council received the Planning Inspector’s post hearing letter on Monday, 21st March 2022. The letter follows the completion of the Stage 4 hearings and marks the start of the next stage of the Local Plan preparation, which is known as the ‘Main Modifications’ stage. The letter is not to be confused with the Final Inspector’s report on the Local Plan, which will be written after completion of the Main Modifications consultation.

The Council is now seeking comments on CC149d Calderdale Local Plan Habitats Regulations Assessment - Air Quality Assessment. (HRA).

The Council consulted on the HRA in 2018, prior to submission of the Local Plan to the Secretary of State (see SD10, SD11 and SD12.1 to SD12.6).

Natural England expressed concern, during this consultation, that insufficient evidence had been submitted within the HRA with respect to the assessment of traffic emissions on the South Pennine Moors SPA/SAC. They stated that an assessment of air quality impacts associated with the Local Plan will be needed.  An air quality assessment to inform the HRA has been undertaken and the Council are now consulting on this assessment.

This is a statutory consultation and you are invited to make representations. Please submit representations to spatial.planning@calderdale.gov.uk. Comments are invited between Friday 4 February and 5pm on Monday 21 March 2022.

The Inspector wrote to the Council asking for further information with regards to Smart Motorways and how they will affect the Local Plan after the Government announced on 12th January 2022. The roll-out of new all lane running Smart Motorway schemes is to be paused until 5 years of safety data is available. Please see the Inspectors message to the Council in document INS27. The Council have responded to the Inspector, please see document CC122a.

18th January

CC166 is now available to view. This note provides a response to the Inspector regarding the assumptions in the viability work, with regards to Part L of the Building Regulations and completes action point 35 for Matter 8 in the Stage 2 Task list (CC85).

CC165 is now available to view. This note provides a response to the Inspector regarding the status of two Local Plan sites in the Replacement Calderdale Unitary Development Plan and completes action point 64 in the Stage 2 Task list (CC85).

13th January

The final Local Plan hearing session on Air Quality took place yesterday. The session was carried out virtually and streamed live for observers to view on the Councils YouTube Channel. 

This was followed by a closing session with the Inspector and the Council. The next steps and timelines were addressed. 

The Council will now work towards finalising any outstanding action points and complete work on Main Modifications, the Inspector will issue a post hearings letter in due course. All information, as it becomes available, will be placed in the Examination Library and updated in the Examination News.

CC163, Capacity of LP0454 - Land Off Wheatley Road, Lee Mount, Halifax is now available to view in the Examination Library. This document is in response to item 180 from the Stage 2 Action List (CC85d).

Live hearing update: The hearing will no longer be held as a live session at The Shay. It will be carried out virtually and may be observed by everyone on the Councils YouTube Channel. CC148 is a note from the Council highlighting a retraction with regards to a matter raised from the hearing session on the Garden Suburbs which took place last week on Tuesday 15th June.

The Inspector has issued a post Stage 3 Hearing message to the Council regarding the Councils Housing Trajectory, see: INS24 Inspectors post Stage 3 Hearing message. The Council have been asked to produce a revised trajectory within the next few weeks and the document to be published for a short period of consultation. Also as discussed at yesterday’s hearing session, the Inspector said it may be necessary to hold a further hearing session on housing supply once the consultation closed, potentially as part of a Stage 4 hearing session which is provisionally planned for Autumn 2021. 

17th June 2021

The Local Plan Stage 3 hearings finished today with a final session where the Inspector Ms Child and the Spatial Planning team reviewed this weeks action points and Main Modifications. These will be available to view shortly on document CC85. With regards to the way forward, there are some documents which will be released in due course for public consultation. This may lead to a short Stage 4 hearing session in the Autumn, before the Inspector is able to release her Post Hearing letter to the Council. After the hearing session this morning, the Inspector will hold a 'mop up' session with the Council to cover any action points raised during this weeks hearings.

In advance of the hearing session on Tuesday afternoon, 15th June, Strategic Road Network interventions and transport and delivery issues relating to the Garden Suburb sites (LP1451 and LP1463). Stage 3 hearings are due to commence next week on 15th June at 10am. All information may be found on the Local Plan Hearings page. INS20d – an updated Hearings Programme and Agenda including participants is now available in the Examination Library.

At the Council's request, the Inspector has agreed that it would assist participants to circulate the following two maps CC143 – LP1451 and CC144 – LP1463 - Developable areas and availability, in advance of the hearing session on Tuesday afternoon, 15th June.

Further to a request from the Inspector to the Council, CC125b a revised extant pp table is now available for your information in advance of the Housing Supply hearing on Wednesday morning 16th June. This table is an addendum to document CC125 Housing Trajectory Update Five Year Housing Land Supply Update and the Council have indicated that there are no Permissions in Principle. Participants should read the table in conjunction with the notes at the end.

Having reviewed the modifications to the last part of Policy HS6 in relation to rural exception sites, as set out in CC124, the Council notes that the draft modifications do not actually achieve the intended purpose of increasing the flexibility of the Policy. Peacock and Smith Ltd have submitted a site plan on behalf of Crosslee Plc in response to consultation document CC109 - Mixed Use Allocations Consultation. At the Council's request, the Inspector has agreed that it would assist participants to circulate SS59 - LP0032 site plan in advance of the hearings. The Council have added this site plan to their evidence documents.

CC132 Update

The changes to CC132 were a result of the document moving from its draft to final version. The draft and final versions of CC132 followed one another in close succession and the Council was keen to put it into the public realm as soon as possible and then to update them when the final version became available.

We recognise though that the version history should have been made clear on the Examination webpage because this has caused unnecessary confusion. We apologise for this. Although the Council does not consider that the changes between the draft and final versions of CC132 were substantive, in the interests of transparency, the Council will run an additional period for representations to be submitted on document CC132 and accompanying CC132a.

Considering air quality is not part of the agenda at the Stage 3 Hearings the Council will hold the additional 14 day consultation once these hearings have closed. This will allow participants to prepare and focus on the forthcoming matters. The Council will also publish a note produced by consultants WSP which will set out the changes between the two documents and the reason for these changes.

The Council is looking in to concerns which community and environmental groups raised with them on 24th May 2021 relating to items in document CC132 Calderdale Air Quality Assessment Report. The Council will post a response with their findings, in the Local Plan News section of the Examination website page once they have had an opportunity to examine the document. The Planning Inspector is aware of any concerns raised.

Due to the high level of interest in a number of the Stage 2 hearings sessions, it has been necessary to revise the second part of the hearings programme to allow additional time for certain items. It is now proposed to allow a whole day for each of the Garden Suburb allocations (Matter 15) and for the housing sessions on Elland (Matter 17) and Northowram and Shelf (Matter 20).

Other changes include:

  • New dates for the housing and employment supply sessions (Matters 22 and 23) as these need to take place after the site-specific sessions.

BP08 - Housing Delivery Test Action Plan Draft has now been added to the Examination Library.

This Action Plan has been produced in response to the results of the Housing Delivery tests for Calderdale of 2019 and 2020. The Housing Delivery Test compares the number of dwellings completed over a rolling three year period with a target. The result is expressed as a percentage. The test is applied to all planning authorities annually. Authorities achieving 95% or less are required to prepare a Housing Delivery Test Action Plan. Calderdale scored less than 50% in both tests and this Action Plan is a response to those results. It examines the reasons behind Calderdale's low scores and suggests ways in which the housing completion rate might be improved. This includes the adoption of the Local Plan and the increase in allocated housing sites.

The Council is open to suggestions and comments regarding ways in which its completion rate might be improved. In the first instance these should be directed to:

At the request of the Inspector, the Council has re-run its modelling of the housing requirement taking account of the 2018 based household projections. The outcome of this exercise is set out in document CC63a.

Released today - CC62b Updated Transport Evidence Base Technical Note 13: Assessment of Cumulative Impact - 2020, now showing missing sites between 253 and 1046 in the table in Appendix 1. The Inspector has granted an extension to anyone wishing to submit comments on this document. All comments must reach the Programme Officer by midday Monday 31st August at miny.schofield@calderdale.gov.uk

The Inspector has now released to the Council the Draft Hearings Programme with participants for Stage 2 (INS 12). Participants, please check your details and inform the Programme Officer of any changes.

Due to COVID-19, all hearings will take place by video conferencing. Arrangements for the hearings will be released in due course.

CC42 to CC59 have recently been added to the Examination Library, under the 'Councils Documents (CC)' section. Other documents will be added as they become available.

CC17a - Comprehensive list of Tasks and Modifications from Stage 1 has been added. This version works through the original task list and highlights the Councils supporting documents.

INS09a - Inspectors pre hearing note 3 has also been added. This version shows the Councils response and lists any supporting documents which have been released.

Document CC57 - Calderdale Local Plan - Publication Draft - Working List of Modifications (April 2020), is referred to in the Inspectors Matters, Issues and Questions has now been added.

Stage 2 Hearings

The Inspector has now released to the Council, Stage 2 Guidance Notes and Inspectors Matters, Issues and Questions. The Inspector is also inviting individuals who wish to participate in the Stage 2 Hearings to contact the Programme Officer by 5pm on Monday 20th July 2020 and for hearing statements to be received by 5pm on Monday 3rd August 2020. The Programme officer is happy to receive all correspondence by email. However, paper copies by post will also be accepted.

Public Consultation Update

A public consultation was held earlier this year covering a revision to the Housing Requirement and an increased supply of sites to meet this need. The Council were also seeking comments on the Sustainability Appraisal (2019) supporting the proposed changes and the update to the Habitats Regulation Assessment.

This consultation ran for 6 weeks and ended on 24th February 2020.

All consultation responses are now available to view on the Councils Consultation Portal.

The Inspector, Ms Katie Child, has now had the opportunity to review all of the responses. She will shortly be issuing further details with regards to Stage 2 Hearings and a set of Pre Hearing Questions.
