His Majesty's Land Registry (HMLR) project
You and your solicitor will want to find out information about a property before you buy it. One area of information is whether there are any ‘Local Land Charges’ registered against it.
These charges might:
- restrict the use of the property;
- or be a financial charge against the property
From 28th October 2024, our LLC Register will only be on His Majesty’s Land Registry (HMLR). For details about charges that affect a property in Calderdale, visit: HMLR.
In addition to any charges that affect a property, you will want to know if anything else might affect it.
About this service
The LLC Service provides responses to a series of questions.
- They give you information about:
- planning applications;
- planned developments;
- highway schemes;
- and other matters that affect the property.
- They will often be arranged by your solicitors/licensed conveyancer when they are dealing with your property purchase. They make sure you are aware of all relevant facts about the property, before you decide to buy.
They will either:
- Ask us to provide verified responses to these questions;
- or they will organise a 'personal search' to be carried out.
Verified Property Searches
To complete a search, we must answer a series of questions on a standard form called a CON29.
These are 'warning' questions about anything that is planned that can affect the property. There are two parts to this form:
Con 29 (R) Required Enquiries of the Local Authority (2007) Edition
Enquiries 1-3 deal with enquiries relating to planning, highways and environment services, which can affect the property or land. Answers to these enquiries are required on all occasions.
Con 29 (O) Optional Enquiries of the Local Authority (2007) Edition
Enquiries 4-22 are charged for separately. Each question relates to a specific situation, such as high hedges or public footpaths.
Your solicitor normally makes a request for these forms to be completed by us. Although, you can also get them from a legal stationer.
Our turnaround time for these is 5 to 10 working days.
- Requests should be made online, rather than by post.
- Payment should be made via BACS (details available on request) and not by cheque.
Personal Searches
These can be carried out by anyone. Although, they are normally done by a 'Personal Search Agent' that has been instructed by a solicitor/conveyancer.

When you email a service with an EIR request, you must:
- Attach a map of the search area and give details of the information you need.
- Put 'EIR request and the site address' in the subject box.
- Include a list of CON29 (R) and (O) questions you need an answer for.
- We still expect customers to source information themselves, where it is available online.
Note:
- We aim to deal with all EIR requests in date order. Please do not chase your request until the turnaround period has passed. This will allow staff to focus on returning searches.
- If your EIR request is very urgent, please ask your search provider to contact the service. We try to prioritise urgent requests.
There is a fee of £50 per question where the information is not publicly available for:
- a CON29 (O) question;
- or you have an 'Additional Question'.

How to check if Planning Conditions have been complied with
You can search planning application documents to see if compliance with conditions has been confirmed or not, see: Public Access.
- After 2010 applications had to be submitted to establish compliance. (These have the suffix COMP or DISC).
- Before this point it was done informally by letter. Not all documents on pre-2010 applications are available online. To request these, email: planning.applications@calderdale.gov.uk.
If it is not clear if the conditions have been met, you can make a formal application to confirm this. There is a fee for this application of:
- £34 for householder applications (the original permission will have a reference number and a suffix of HSE).
- £116 for all other types.
To do this, you can:
- Apply and pay online via the Planning Portal.
- Use a downloadable form from the Planning Portal.
- Submit this by email to: planning.applications@calderdale.gov.uk;
- and pay over the phone: 01422 392237. (Please wait to be connected to a Customer Service Advisor.)
- Email your request to: planning.applications@calderdale.gov.uk. Quote the original planning permission number and phone to pay, as above.
Please note: The process takes around eight weeks. If you apply as part of the conveyancing process, do it as soon as possible to avoid any delays.
How to submit a request for a Verified Property Search

Submit your 'Verified Property Search' request on the standard forms and email to: locallandcharges@calderdale.gov.uk.
Please note: Payment should be made via BACS (details available on request) and not by cheque.
There are also various search companies that can submit your search for you.
